  1. End User Licence Agreement

  3. By installing this software (hereafter referred to as æthe ProductÆ), 
  4. you (hereafter referred to as æthe licenseeÆ) are consenting to be 
  5. bound by and become a party to this agreement. If licensee does not 
  6. agree to all of the terms of this agreement, then the licensee must 
  7. not install this software.
  8.  
  9. 1.  Proprietary Rights.  Title, ownership rights, and intellectual 
  10. property rights in the Product(s) shall remain in WebPrecinct and/or 
  11. its suppliers. Licensee acknowledges such ownership and intellectual 
  12. property rights and will not take any action to jeopardise, limit or 
  13. interfere in any manner with WebPrecinct's or its suppliers' 
  14. ownership of or rights with respect to the Product. The Product is 
  15. protected by copyright and other intellectual property laws and by 
  16. international treaties. Title and related rights in the content 
  17. accessed through the Product are the property of the applicable 
  18. content owner and are protected by applicable law. The license 
  19. granted under this Agreement gives Licensee no rights to such 
  20. content. Any copy shall contain all notices regarding proprietary 
  21. rights as contained in the Product originally delivered by Licensor.

  23. 2.  Restrictions.  Except as otherwise expressly permitted in this 
  24. Agreement, Licensee may not: (i) modify or create any derivative 
  25. works of the Product or documentation, including translation or 
  26. localisation (LicenseeÆs code written to published APIs (application 
  27. programming interfaces) for the Product(s) shall not be deemed 
  28. derivative works); (ii) decompile, disassemble, reverse engineer, or 
  29. otherwise attempt to derive the source code for the Product (except 
  30. to the extent applicable laws specifically prohibit such 
  31. restriction); (iii) encumber, sell, rent, lease, 
  32. sublicense, use the Product in a timesharing or service bureau 
  33. arrangement, or otherwise transfer rights to the Product; (iv) copy 
  34. the Product (except for an archival copy which must be stored on 
  35. media other than a computer hard drive) or documentation; (v) remove 
  36. or alter any trademark, logo, copyright or other proprietary notices, 
  37. legends, symbols or labels in the Product(s); (vi) modify any header 
  38. files or class libraries in the Product; (vii) create or alter tables 
  39. or reports relating to the database portion of the Product (except as 
  40. necessary for operating the Product); (viii) publish any results of 
  41. benchmark tests run on the Product to a third party without 
  42. WebPrecinctÆs prior written consent; (ix) use the database provided 
  43. for use with the Product except in conjunction with the relevant 
  44. Product; or (x) use the Product on a system with more CPUs than the 
  45. number licensed, by more Users than have been licensed, on more 
  46. computers than the number licensed, or by more developers than the 
  47. number licensed, as applicable.

  49. 3. Disclaimer of warranty for free software. Free software is 
  50. provided on an "as is" basis, without warranty of any kind, including 
  51. without limitation the warranties that it is free of defects, 
  52. merchantable, fit for a particular purpose or non-infringing. The 
  53. entire risk as to the quality and performance of the free software is 
  54. borne by licensee. Should the free software prove defective in any 
  55. respect, licensee and not licensor or its suppliers or redistributors 
  56. assumes the entire cost of any service and repair. In addition, the 
  57. security mechanisms implemented by the free software have inherent 
  58. limitations, and licensee must determine that the free software 
  59. sufficiently meets its requirements. This disclaimer of warranty 
  60. constitutes an essential part of this agreement. No use of the free 
  61. software is authorised hereunder except under this disclaimer.
